Terms of Use

1. Our Services

The Services are available at antagnistai.com. Information provided through the Services is not intended for distribution where such distribution would be contrary to local law. Users who access the Services from other locations do so at their own initiative and are responsible for local law compliance.

2. Intellectual Property Rights

All content, source code, databases, software, designs, audio, video, text, graphics, trademarks, and logos within the Services are owned by or licensed to us and protected by applicable intellectual property laws. Content is provided "AS IS" for your personal, non-commercial use only.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services for personal, non-commercial use. You may not copy, reproduce, or redistribute any part of the Services without our written permission, or use the content for commercial purposes. For any other use, contact olha@antagnistai.com.

3. User Representations

By using the Services, you represent that: all registration information you provide is accurate and complete; you have the legal capacity to agree to these Terms; you are at least 18 years old; you will not use the Services through automated or non-human means; and you will not use the Services for any illegal or unauthorized purpose.

4. User Registration

You sign in using your Google account. You are responsible for maintaining the confidentiality of your account and for all activity under it. We may remove or reclaim usernames that are inappropriate or objectionable.

5. Purchases and Payment

Payments are processed by our payment provider and accept major cards (Visa, Mastercard). You agree to provide accurate payment information. All payments are in US dollars. Sales tax may be added where required.

6. Subscriptions

Subscriptions automatically renew unless canceled. By subscribing, you consent to recurring charges without requiring approval for each cycle.

If you have not used any subscription features (no fights initiated), you may request a refund by contacting olha@antagnistai.com. Requests are reviewed within 28 business days. Your cancellation takes effect at the end of the current paid term.

7. Prohibited Activities

You agree not to: systematically retrieve data to create a database or directory without written permission; trick, defraud, or mislead us or other users; circumvent or disable security features of the Services; disparage or harm us and/or the Services; use information from the Services to harass or harm others; upload or transmit viruses or other harmful material; copy or adapt the Services’ software; or use the Services as part of any effort to compete with us.

8. User Generated Contributions

The Services allow you to generate text and dialogues with AI. Parts of your results (for example, a shared verdict card) may be visible to others if you choose to share them. You warrant that your contributions do not infringe third-party rights and are not illegal, harassing, or obscene.

9. Contribution Licence

You retain ownership of your contributions. However, you grant us the right to access, store, and process them in accordance with our Privacy Policy to provide AI responses and analytical feedback.

10. Third-Party Accounts

You may link your account to third-party accounts (e.g., Google). You represent that you are entitled to disclose your third-party login credentials to us without breaching any agreement governing those accounts.

11. Third-Party Websites and Content

The Services may contain links to third-party websites. We do not investigate or monitor these for accuracy. Accessing third-party websites is at your own risk.

12. Services Management

We reserve the right to: monitor the Services for violations of these Terms; take legal action against users who violate the law or these Terms; and manage the Services to protect our rights and property.

13. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by it.

The Services are hosted on Google Cloud (Firebase) infrastructure. Your data may be stored and processed in data centers outside your country. By using the Services, you consent to data transfer and processing on Google’s global infrastructure.

14. Term and Termination

These Terms remain in effect while you use the Services. We reserve the right to deny access or terminate your account at any time, without warning, for any reason, including violation of these Terms. You may delete your account at any time on the Account page.

15. Modifications and Interruptions

We reserve the right to modify or remove content at any time without notice. We are not liable for any modification, price change, or interruption of the Services. We cannot guarantee uninterrupted availability.

16. Governing Law

These Terms are governed by the laws of Ukraine. You and Mahaon irrevocably consent to the exclusive jurisdiction of the courts of Ukraine for any dispute arising from these Terms.

17. Dispute Resolution

All disputes related to these Terms are subject to the jurisdiction of Ukrainian courts. Mahaon reserves the right to bring proceedings in the country where you reside.

18. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE IS AT YOUR SOLE RISK. ANTAGONIST AI CHARACTERS ARE DESIGNED TO BE ADVERSARIAL AND PROVOCATIVE. BY USING THIS SERVICE, YOU ACKNOWLEDGE THAT YOU MAY BE EXPOSED TO CHALLENGING OR ADVERSARIAL CONTENT AS PART OF THE TRAINING SIMULATION. THIS IS NOT THERAPY.

19. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT. OUR LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE ONE (1) MONTH PRIOR TO ANY CAUSE OF ACTION.

20. Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, or claim arising from: (1) your use of the Services; (2) breach of these Terms; (3) violation of third-party rights.

21. User Data

We perform regular backups but you are solely responsible for data you transmit. We have no liability for loss or corruption of such data.

22. Electronic Communications

By using the Services, sending emails, or completing online forms, you consent to receiving electronic communications and agree that electronic signatures, contracts, and records satisfy any legal requirements.

23. Miscellaneous

These Terms and any policies we post constitute the entire agreement between us. Our failure to enforce any right is not a waiver. If any provision is found unlawful, the remaining provisions remain in effect.
